Local validation lists consultation

Public Consultation Period on Local Validation Lists from 15 July 2019 to 09 September 2019

When making a formal planning application, applicants are required to provide information that meets the requirements of regulations set out within the Town and Country Planning (Development Management Procedure) (England) Order 2015. Within this legislation, only limited information is required in order to make a submission to the Local Planning Authority. Therefore, Local Validation Lists are a tool used by Local Planning Authorities to set out more detailed requirements for appropriate supporting information in order to ensure that a proper assessment of any development proposal can be made. The existing lists in use by the Council were last updated in June 2017 and require updating in accordance with government advice.

Paragraph 43 of the National Planning Policy Framework (NPPF) reads:

The right information is crucial to good decision-making, particularly where formal assessments are required (such as Environmental Impact Assessment, Habitats Regulations assessment and flood risk assessment). To avoid delay, applicants should discuss what information is needed with the local planning authority and expert bodies as early as possible.

The Council wishes to provide more detailed up-to-date lists which encourage good quality submissions and aids positive and speedy decision-making.

Further guidance on Local Validation Lists published within the NPPG states:

The local list is prepared by the local planning authority to clarify what information is usually required for applications of a particular type, scale or location.

In addition to being specified on an up-to-date local list published on the local planning authority’s website, information requested with a particular planning application must be:

  • reasonable having regard, in particular, to the nature and scale of the proposed development; and
  • about a matter which it is reasonable to think will be a material consideration in the determination of the application.

Proposed Lists

The Council currently has 25 Local Validation Lists included on its website.

In order to assist in identifying the relevant list quickly and easily, it is proposed to group the application forms and the new lists as follows:

  • Applications for Planning Permission, Listed Building Consent and Advertisement Consent
  • Post-Permission applications (e.g. non-material amendments, variation/removal of condition and approval of details reserved by condition)
  • Prior Notification Applications (forms with some lists where further information may be required)
  • Certificates of Lawfulness applications

It is proposed to provide a table of national requirements followed by a table of local requirements. Within the table, it is proposed to state the name of the document, when it is likely to be required and what the document typically contains. In addition, hyperlinks to further helpful guidance are included and the policy context for requiring the information is also included.
